Following a short debate, the Committee decided, by a majority of votes, to propose that the National Assembly accept the proposal of the High Judicial Council and, pursuant to article 79, paragraph 7, of the Law on Judges, decide to terminate the office of Nata Mesarovic, President of the Supreme Court of Cassation.
In the Report to be to be submitted to the National Assembly, the Committee noted that, by the decision of 20 December 2012, the Constitutional Court established that the provision of article 102, paragraph 5, of the Law on Judges, proscribing the procedure for the election of President of the Supreme Court of Cassation, does not comply with articles 144, paragraph 1, of the Constitution, as the provision changes the constitutional provision by omitting the constitutional obligation to obtain the opinion of the General Session of the Supreme Court of Cassation in the election procedure for President of the Supreme Court of Cassation. In light of said Constitutional Court Decision, the Committee believes that there are grounds for the termination of function of the President of the Supreme Court of Cassation, Nata Mesarovic, states the Report.

The Committee went on to propose that the National Assembly adopt a decision on the termination of office of Branka Atanackovic, public prosecutor at the Novi Sad Higher Public Prosecutor’s Office, due to her reaching retirement age.
